The Problem Patient: Identification and Treatment
Wednesday, December 4
1–2pm, Central Time

Description:
An ounce of prevention is worth a pound of cure. In a high performing-practice, most patients are satisfied—but not all. How do you identify a “problem patient” before you start to work on him or her?

As hard as we try to screen patients well, no one’s processes are perfect. Mismanaged expectations can create post-procedure headaches. And even when you set expectations properly, barely noticeable signs of body dysmorphic disorder may blossom into full view on post-op visit number one.

We’ll discuss:
  • How to identify the problem patient (red flags);
  • How to prevent conflict before it starts; and
  • How to manage conflict with a problem patient when it occurs.
The old adage, “Once you’ve started working on the patient, you’ve bought them,” holds true. We’ll teach attendees how to prevent buyer’s remorse.

Presenter:
Jeffrey J. Segal, MD, JD, ByrdAdatto

Jeffrey J. Segal, MD, JD, is a neurosurgeon turned serial entrepreneur turned attorney at ByrdAdatto who has literally been in both business and medicine. Segal was a neurosurgeon in private practice before beginning the second phase of his career as a serial entrepreneur in the healthcare field. He then founded or co-founded four separate health care startups. Segal lives and breathes healthcare and understands it viscerally.

How to Legally Reward Patients for Referrals Without Violating Anti-kickback Laws
Wednesday, January 22
1–2pm, Central Time

Presenters:
Robert J. Fisher, JD and Bala Mohan, JD, ByrdAdatto

Robert J. Fisher’s passion for health care traces back to his high school days of shadowing doctors. His passion evolved in college, where he studied as a pre-med major. The last major evolution of Robert’s interest in health care was the transition to an interest in health care law. With this education, a business attorney for a father and a renowned orthopedic surgeon for a father-in-law, Robert has the pedigree for success as a business and health care attorney at ByrdAdatto.

Bala Mohan, JD, knew from a very young age that her choice of career would be related to science because she excelled in her biology and chemistry coursework. With a strong passion for genetics and the desire to find a cure for her mother—who was diagnosed with diabetes at an early age—Mohan obtained a Bachelor of Technology in Pharmaceutical Biotechnology. Having worked as a scientific researcher during her undergraduate studies, Mohan greatly values attention to detail and is a meticulous person. She then pursued a master’s in entrepreneurial biotechnology to gain knowledge about business and startups. This landed her a position with Cleveland Clinic Innovations, where she evaluated over 100 innovations and negotiated deals with potential investors. In this role, Mohan had the opportunity to interact with business and health care lawyers from multiple health care organizations, and she quickly realized that her real calling in life was to be a health care attorney. Subsequently Mohan obtained her JD and was able to pursue a career that combined all her interests—science, business, and law.

The Basics of Patient Consults
Recorded November 13, 2019

Description:
Patient consultations, or “good-faith exams,” are among the most crucial aspects of proper patient care, but this important first step is often overlooked in the medical spa setting. In fact, AmSpa’s 2019 Medical Spa State of the Industry Report found that 13% of medical spas don’t perform any medical consultation prior to treatment, and 15% of medical spas are using the wrong people to perform the consultations. This is a big deal because there has been a rash of undercover investigations across the country, and even arrests of medical spa owners and practitioners, resulting from the failure to properly conduct patient consultations before providing treatment in the medical spa setting.

Renee will answer the following questions:
  • When should the initial consultation take place?
  • Who can conduct initial consultations?
  • What are the required steps of the consultation?
  • How often must patient consults take place?
  • How does telemedicine factor into patient consultations?
  • What lessons did we learn from the 2018 Houston arrests when it comes to proper consultations?

Presenter:
Renee E. Coover, JD, ByrdAdatto

Renee E. Coover, JD, is an associate with ByrdAdatto, a law firm focusing on business, healthcare, and aesthetics. She has a unique background, blending litigation with healthcare law. A former litigator in high-stakes employment cases, Renee has extensive experience with counseling and representing businesses in employment matters, policies, and contract disputes, and defending business owners in state and federal trials. She has also served as General Counsel for the American Med Spa Association, advising health care professionals on regulatory and legal issues governing the medical spa industry.

FaceTime, Skype and Med Spas
Recorded October 30, 2019

Description:
Because we live in a digital society, it is no surprise that more and more medical spas are choosing to utilize telemedicine—or, in some states, telehealth—as part of the treatment of their patients. Generally, telemedicine is the provision of health care services using telecommunication means (e.g. via FaceTime or Skype) by a health care practitioner in one location to a patient in another. While telemedicine makes patient access easier than ever before, telemedicine compliance can be tricky. As telemedicine gains popularity, medical spas should be aware of the various state and federal rules for providing telemedicine in their practices. This webinar will provide an overview of what medical spas need to consider when choosing to employ telemedicine and how to navigate the laws that regulate it.
